Report on indigent defense in U.S.

The GAO report reveals that in the last five years, federal dollars allocated to indigent defense services only went to jurisdictions with public defender offices and coordinated assigned counsel/contract programs. These "systems" must overcome significant obstacles before they can provide adequate service to indigent defendants. The report suggests that Congress increases federal funding for indigent defense, and remove all restrictions. States legislatures need to increase legal aid funding. The Indiana and Pennsylvania examples of unclaimed class-action money should be followed by state supreme court. Federal actors can bridge the gap through increasing awareness and increasing congressional appropriations.

GAO's report also lists federal grant programs that provide support for indigent defense. Four DOJ grant programs require funding for indigent defense, including the John R. Justice, Capital Case Litigation Initiative, Wrongful Conviction Review, and Juvenile Indigent Defense Clearinghouse. This report shows how much money is allocated to indigent Defense across the country by comparing the four programs.
